1. The promoter is Cellarmaster Wines Pty. Ltd.
   ABN 95 076 727 949 of the prize draw for an ANZ Wine Club Gift Voucher.
2. Terms and conditions: these terms and conditions govern the prize draw.
3. Eligible entrants: subject to rule 4, a person (individual or body corporate) who in the period 7am EST on 1 September 2008 to 11pm EDT on 31 December 2008 orders and purchases a case (12 or more 750ml bottles) of wine from ANZ Wine Club obtains one entry to the draw for each whole case purchased. The Promoter’s decision concerning qualifying purchase orders is final.
4. Ineligible entrants: the draw is not open to any person(i) at the time of the draw is a resident in Northern Territory or resident outside Australia; (ii) under the age of 18 years; or (iii) an employee of the Promoter or their immediate family member.
5. Prize: There will be one draw and one prize winner. The prize is one $2,000 ANZ Wine Club voucher redeemable through purchases of Wine from ANZ Wine Club. The prize is valued at $2,000. The prize is not transferable, nor redeemable for cash. The judges decision is final and no correspondence will be entered into.
6. Draw: The prize winner will be determined by a draw conducted by the Promoter at Level 25, Tower 2, 101 Grafton Street, Bondi Junction NSW 2022 at 12 noon AEDT on 14 January 2009.
7. The winner: The winner will be promptly notified by telephone/mail and email (to numbers and addresses shown in ANZ Wine Club’s records) and the result also published in the public notices section of The Australian newspaper on 23 January 2009. The winner must claim the prize before a second chance draw winner is drawn as below.
8. Second chance winner: If the winner of the draw cannot be contacted, is unable to satisfy these competition conditions or forfeits or does not claim their prize then the Promoter will conduct a second chance draw at its above address on 14 April 2009, subject to permission from the department of Gaming and Racing (NSW) and any directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). The second chance draw winner will be notified by telephone/mail and email(to numbers and addresses shown in ANZ Wine Club’s records) and the result also published in the public notices section of The Australian newspaper on 17 April 2009.
9. Unclaimed prize: If neither the winner nor second chance winner claims the prize, the Promoter will deal with the prize as Lottery and Gaming Regulations 1993 (SA) (or if then in force, Lottery and Gaming Regulations 2008 (SA) requires.
10. Product safety: The Promoter encourages responsible drinking. Legal age consumers of wine products are advised to consider safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines being as at 15th July 2008 up to 6 standard drinks on any one day, no more than 3 days a week for males and up to 4 standard drinks on any one day, no more than 3 days a week for females.
11. Entries: The Promoter is not liable to ensure that an entrant’s telephone number, street or electronic address shown in ANZ Wine Club’s records are correct or current at the time of the draw. The Promoter may retain information about entrants to the draw and, subject to applicable laws, use that information for future promotional, marketing and publicity purposes including email contact.
12. The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or a consequential loss) or for personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.
13. The Promoter reserves the right to vary the rules of any competition or any prizes offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control, subject to state legislation. The promoter will not be liable for any losses to any party arising from any variation or cancellation.
